Title: Mental Health and Substance Abuse

Learning Objective:

By Order of the Supreme Court of Illinois, attorneys licensed to practice in the State of Illinois must now have one hour of continuing legal education (“CLE”) credit in Mental Health and Substance Abuse.  This one-hour CLE course is designed to introduce attorneys to, and enhance the understanding and knowledge of attorneys about:
  1. the fact that many lawyers are experiencing chronic stress and high rates of depression and substance abuse;
  2. the connection between mental health and substance abuse;
  3. the Report from the National Task Force on Lawyer Well-Being entitled, The Path to Lawyer Well-Being:Practical Recommendations for Positive Change;
  4. how toxic working environments can undermine the mental health of attorneys and drive them to substance abuse;
  5. some of the workplace practices and triggers that can lead to mental health and substance abuse issues; and
  6. some suggested steps to create and maintain a positive working environment that promotes positive mental health and discourages reliance on substance abuse.

Course Description:

This is an introductory course designed to educate attorneys about (1) the Report from the National Task Force on Lawyer Well Being entitled The Path to Lawyer Well-Being:  Practical Recommendations for Positive Change, and (2) how toxic working environments can undermine the mental health of attorneys and drive them to substance abuse.  The course first identifies some of the mental health and substance abuse problems the legal profession is facing, including depression, alcoholism, and drug abuse.  This is followed by an examination of some of the toxic workplace practices and conditions that can undermine mental health and result in substance abuse.  These practices and conditions include (a) an out-of-whack culture that does not afford a work-life balance or that well integrates one’s work and personal lives; (b) a decline in civility in society and especially in the practice of law; (c) alienation; (d) an emphasis on alcohol at social events; (e) discriminatory practices; (f) sexual and other harassment; and (g) workplace bullying.  The course discusses some suggested steps for creating and maintaining a positive working environment that promotes positive mental health and discourages reliance on substance abuse.  It also includes strategies from faculty member, Bernie Dyme, who has a Masters Degree in Social Work and is the founder of an EAP Consulting Practice, about what organizations can do to assist individuals who are experiencing mental health issues, and do so in a safe and effective way, including “Mental Health First Aid.”
